1- The Terms and Conditions apply to every person ("Participant") participating in the AliveNow Poster Campaign (the “Campaign”) conducted by United Spirits Limited ("Organizer").
2- By entering this Campaign, all Participants are deemed to have accepted and agreed to abide by these Terms and Conditions. If you are not agreeable to any of the Terms and Conditions, please do not participate in this Campaign.
3- At the time of entering the Campaign, the Participant must be a resident of India and must be an Indian citizen. Participant who feature in the photos that may be submitted as a part of the Campaign, must not be less than twenty one (21) years of age. The age of the Participant who feature in the photos that may be submitted as a part of the Campaign shall be calculated from the date a Participant submits his/ her entry for the Campaign. All entries in this Campaign will be automatically disqualified without notice if an entrant is less than twenty one (21) years of age or if he/ she promotes this Campaign through unsolicited commercial e-mail and/or multiple postings.
4- The Campaign starts on 19th September 2020 and ends on 30th November 2020 ("Closing Date"). Each Participant must complete the below entry process, on or before the Closing Date. Results will be declared 45 working days from the Closing Date. The Organizers reserve the right to change the duration of the Campaign and the date of announcement of the prizes and winners.
5- The Campaign is applicable across all the states in the Indian sub-continent.
6- Process of entry into the Campaign: Participants can participate in the Campaign through following 3 routes:
a- By choosing their real heroes from the list of 21 people that Organizer has identified.
b- By choosing from a pre set template available of professionals (doctors, Policemen, etc).
c- By uploading a picture of person whom they would nominate as the ‘Real Hero’ –
For all entries uploaded by the Participant as per this option (c), the Participant represents and warrants that:
i- Participant will procure the required consents from Real Heroes for use of their personal information including name, image, phone numbers, email ids etc. (“Real Heroes Information”) for use by the Organizer under this Campaign including the right to prepare advertising and promotional materials and/or to produce the same on different media platforms including but not limited to Digital, Website, OTT etc. and/or on such other platforms as identified by Organizer, from time to time at its sole discretion.
ii- Participant shall share the details of only those Real Heroes who have given their consent for use of their personal information in the manner contemplated under this Campaign.
iii- articipant shall be solely responsible to arrange for the consent from Real Heroes for use of the Real Heroes Information by Organizer and Organizer shall in no way be responsible for the same.
iv- Participant shall immediately inform the Organizer if such consent is revoked by the Real Heroes. Participant acknowledges that Organizer is receiving the Real Heroes Information from the Participant solely on the basis of the above warranties and representations given by the Participant. Participant shall be responsible for any consequences that may arise out of use of Real Heroes Information provided to Organizer including claims from such Real Heroes and Participant hereby agrees to release and discharge Organizer, its representatives, agents, employees and directors from any and all claims and causes of action of any kind or nature whatsoever, that may arise from the use of Real Heroes Information by Organizer as contemplated under this Agreement.
7- Notwithstanding anything contained herein, Organizer may, at its sole discretion, remove or refuse to publish any entries which is in its sole discretion is considered defamatory, misleading, abusive, unlawful, or otherwise inappropriate or is in violation of Company’s practices and against Company’s reputation, or for any other reason whatsoever.
8- No calls, messages or emails to the Organizers will be accepted. By entering the Campaign, each Participant promises that he or she fulfils the eligibility requirements.
9- Rewards: The best entries as chosen by the Organizer at its sole discretion, will get featured on the Royal Challenge social media handles.
General Terms and Conditions
1- Employees of the Organizers or their relatives or employees of the Organizers’ affiliates, group companies, and marketing and promotion agencies are not eligible to participate in this Campaign.
2- Failure to comply with any of these Terms and Conditions (including instructions) will disqualify any Participant from continuing to take part in the campaign and such Participant's participation will be invalid. The Organizers retain the sole discretion to refuse Participants the right to participate if it feels that these Terms and Conditions are being violated.
3- The Organizers reserve the right to change any details of the campaign, including but not limited to amending these Terms and Conditions. Organizer reserves the right to amend, temporarily suspend or withdraw the campaign in its absolute discretion provided that Organizer shall not exercise this right unreasonably. The Participants are advised to regularly check for any updates/amendments.
4- The Organizers shall not be liable to award/provide the rewards for the campaign due to any cause beyond its reasonable control, including but not limited to, Act of God, insurrection or civil disorder, religious strife, war or military operations, terrorist act, partial or total strikes, either internal or external, lock-out, epidemic, blockage of means of transport or of supplies, national or local emergency, earthquake, fire, storm, flood, water damage, governmental, regulatory or legal restrictions, acts or omissions of persons for whom the Organizers are not responsible.
5- By entering this Campaign, Participants agree to hold harmless and keep indemnified the Organizers, their agencies and their affiliates, and judges, if any, of the campaign against any and all liability, damages or causes of action (however named or described) with respect to or arising out of: (i) Participant's participation in the campaign (ii) the receipt or use of the rewards. Participants hereby release, waive and discharge any and all claims of damage, loss or causes of action (including negligence) including but not limited to loss or damage to person or property which the Participant and his/her representatives or assignees may have, suffer or which may hereinafter accrue to the Participant or as a result of the Participant's participation in the campaign or claim of the rewards.
6- The Organizers shall not be liable for any special, indirect or consequential loss or damage, loss of profits, business, revenue and/or goodwill. The aggregate liability of the Organizers, in case of any damage, loss, cost, claim, liability or expense (including legal costs and expenses) caused to or incurred by any act, omission or representation in relation to the campaign shall not exceed the value of gratification won by the winner.
7- The Organizers reserve the right to disqualify any Participant and/or winner who tampers with the entry process or submits an entry that is not in accordance with these Terms and Conditions or who has, in the opinion of the Organizers, engaged in conduct in entering or participating in the campaign which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Campaign and/or the Organizers. The Organizers reserve the right to exclude Participants and/or winners who have been convicted of a criminal offence or who have a criminal court case pending.
8- The Participant warrants that he/she is the sole owner of any and all materials submitted by him/her as part of the campaign including but not limited to all details mentioned on the entry form ("Materials"), and he/she has obtained all necessary consents, if any, and neither the Materials nor its exploitation by ORGANIZER or its affiliates will infringe any rights of any third party. The Participant shall indemnify, defend, and hold harmless ORGANIZER, its affiliates, its agencies and judges, if any, of the Campaign from any and all liability, loss, costs, damage, judgment, or expense (including reasonable attorney’s fees) resulting from or arising in any way out of any such claims by any third parties and/or which are based upon, or are the result of any breach of the warranties in this paragraph.
9- All Participants acknowledge and agree that the decisions of the Organizers with respect to all aspects of the campaign are final and no correspondence will be entered into in this regard in any manner whatsoever.
10- The Organizers shall not be responsible and/or liable in any manner whatsoever for:
(i)- late, lost, illegible, falsified, delayed, incomplete or destroyed entries and all such entries shall be void and may be disqualified at any time;
(ii)- incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, lost delayed or garbled data or transmissions, omissions, interruptions, deletion, defect or failures of any telephone or computer lines or networks, computer equipment, software or any combination thereof;
(iii)- entry materials/ data that have been tampered with or altered shall be considered void;
(iv)- any problems, errors, or negligence that may arise or occur in connection with this campaign, including but not limited to, any damage to the Participant's computer or other technical device, or software, as a result of the Participant's participation in this campaign;
(v)- any failure or breach by any party in connection with this campaign, prize or prizes and accepts no responsibility for any loss suffered by a Participant arising from this campaign.
11- ORGANIZER advocates the responsible service and consumption of alcohol and abides by a strict code of marketing practice for alcoholic beverages. It is a condition of this campaign that Participants comply with applicable regulations and guidelines for the responsible service and promotion of alcohol, (available at www.DrinkIQ.com ). Participants are encouraged to visit www.DrinkIQ.com for information on safe drinking, standard drinks and related issues.
12- The Organizers collect Participants' personal information in order to conduct the campaign. If the information requested is not provided, the Participant is not eligible to participate in the campaign. By entering the campaign, unless otherwise advised, each Participant also agrees that the Organizers and/or its affiliates may use this information and/or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the Participant. Participants' personal information may be disclosed to government authorities and winners' names may be published. A request to access, update or correct any information should be directed to
13- This campaign is in no way sponsored, endorsed or administered by, or associated with Facebook. Each Participant understands that he/she is providing his/her information to ORGANIZER, the recipient(s) of information, and not to Facebook. The information each Participant provides will only be used for the purposes of administering the rewards. All rights are reserved.
14- If any provision of these Terms and Conditions is found to be invalid by any Court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect. Indian laws shall be exclusively applicable to any and all disputes arising out of or in connection with the campaign or these Terms and Conditions. The Courts at Bengaluru shall have sole jurisdiction over any and all disputes arising out of or in connection with this campaign.
